I know most of you have seen Governor Northamâ€™s Executive Order which became effective May 29, 2020, requiring people in public places to wear face masks. I hate those darn things but Iâ€™ve come to realize that they are necessary if we are to control the spread of the coronavirus. The mask is not a perfect defense but that, together with â€śsocial distancing,â€ť is the best hope we have, in my opinion.
One â€ślegalâ€ť thing we business owners must be concerned about is potential liability if we do not wear a mask and someone comes into our place of business and claims to have caught the â€śvirusâ€ť there. The same is true for business employees. A claimant would have a tough burden of proof in that event but the potential risk is there and companies that ensure businesses are worried about that risk. Business owners are well-advised to consult their business liability insurance carriers for advice about how to proceed. The old saying is that â€śan ounce of prevention is worth a pound of cure.â€ť
